kui töölepingus on pandud töösuhte sõlmimise alguseks kaks kuupäeva kas siis on tegemist ehtsa lepinguga või mitte?

17.05, kuid lepingus onka kuupäev 12.05(väidedavalt töölepingu sõlmimise kuupäev)

Ei saa. Ma pakun, et lahend oleks selline nagu Eesti õigussüsteemis ka tavaks on saanud. Kuna töötaja on praeguste seaduste järgi siiski nõrgem pool, siis vaidluste korral rakendatakse töötaja suhtes soodsamat kuupäeva. Topelt kuupäev ei ole lepingu oluline viga ja ei muuda seega lepingut ka tühiseks.

pealegi - miks ei võiks töölepingu sõlmimise kuupäev ning tööle asumise kuupäev erineda?

Töölepingu sõlmimise aluseks on kahte erinevat kuupäeva raske panna. Küll aga saab olla "töölepingu sõlmimise kuupäev" nt 27.07.04 ja "töötaja asub tööle" nt 01.08.2004
Järelikult töösuhe algab 01.08.2004
